Legal aid is not available to your client until we are satisfied on probable cause, reasonableness, and financial eligibility [sections 14 and 15 of the Legal Aid (Scotland) Act 1986]. The date when we are satisfied on these is shown as the “effective date” on the legal aid certificate. Work done before the effective date of legal aid, will not be covered by civil legal aid. A grant will only cover work done before the effective date if it has been done in accordance with the special urgency provisions.
