Where you are required to revise any document drawn by counsel, or where you are ordered to revise a document by the court, the fee payable is a standard fee prescribed at the formal rate.
The formal rate is payable per five sheets, regardless of the status of person carrying out the work, ie qualified/unqualified or the time engaged.
The fee is payable for the perusal of the document and is allowable even where no actual revisal to the document is required.
The rationale behind this is that where counsel has been instructed to conduct the case they are paid a fee to have done the work correctly and as such a revisal of the document is all that ought to be necessary for you to note those papers.
There is no equivalent “revisal” fee under Advice and Assistance as this constitutes representation.
However, a fee will be allowed for perusal of an opinion from counsel at the prescribed rate for time occupied in carrying out work for the client other than work for which a fee is prescribed (ie the “non-advocacy” fee).
