If your client has been refused solemn criminal legal aid they can apply to us for a review of the decision. The letter or notification refusing the application will include details on how to apply for a review of our decision. When asking for a review of the decision to refuse, you should explain the basis on which you are reviewing the decision, provide additional information and address the reason for refusal
If we refuse an application on review, you can submit a new application. Each case will be considered on its own particular merits. We must be persuaded there is some significant new circumstance, which could not have been advanced previously. You must also provide additional documentation to support the new information.
