The interests of justice tests do not apply to ABWOR for Parole Board cases. However, as with any other ABWOR case, you must apply to us for authority if you are proposing to give ABWOR for a case where the client might have other rights and facilities for assistance in the case, or has already received advice and assistance or ABWOR on the matter from you or another solicitor.
It is your responsibility to determine not only whether the proceedings are within the scope of ABWOR, but also whether the client is financially eligible for advice and assistance. If you are satisfied that the client is eligible and that ABWOR is available for the proceedings, you can start work at once.
