Subject to the financial eligibility test being met, you can provide criminal ABWOR for the following proceedings:
- Parole Board proceedings before a tribunal
- Applications under section 42 of the Road Traffic Offenders Act 1988 for the removal of a disqualification
- Proceedings under section 66(6) of the Criminal Justice and Public Order Act 1994 for the return of sound equipment
- Proceedings in connection with an application under section 11 of the Counter-Terrorism and Security Act 2015 (review of decisions relating to temporary exclusion orders)
- An application under paragraph 8 of Schedule 1 to that Act (seizure of passports etc.; extension of 14-day period by judicial authority)
- Applications under section 57 or 58 of the Police, Public Order and Criminal Justice (Scotland) Act 2006 in relation to the variation or termination of a football banning order made under section 51 of that Act
- Proceedings under the Criminal Procedure (Scotland) Act 1995 (the “1995 Act)
You do not need to apply an interests of justice test.
